Exceptions that can change this

  • The clock can start later under the discovery rule when an injury or its cause could not reasonably have been known.
  • Deadlines for minors and for claims against government entities work differently.
  • Claims against a government body usually require written notice long before the filing deadline — sometimes within 90 or 180 days.
