Notice deadlines
Pennsylvania's Workers' Compensation Act requires notice to the employer. Benefits can be affected if notice is given after 21 days, and a claim can be barred entirely if notice is not given within 120 days of the injury.
Filing a claim petition
A claim petition generally must be filed within three years of the injury date where benefits have not been paid.
Third-party claims
Workers' compensation does not cover pain and suffering, and it is generally the exclusive remedy against an employer. Where someone other than the employer caused the injury — a delivery driver, a subcontractor, a defective machine manufacturer — a separate claim against that party may exist alongside the comp claim.
